INTELLECTUAL, INDUSTRIAL PROPERTY & CONSUMER LAW
The Intellectual and Industrial Property and Consumer Law Department focuses especially on the intangible assets of its clients, providing counsel which allows them to protect, acquire, transfer, or license their distinctive marks (such as trademarks and logos), patents and copyrights and related rights.
On the other hand, with consumer rights gaining increasingly more prominence and complexity, and in an age where supervisory and regulatory bodies are exercising increasingly tighter control, the role of the lawyer in directly assisting companies has become imperative.
The team that composes this department takes care of specific issues related to Advertising Law, validating content and providing advice to ensure that the commercial communication of its clients meets legal and regulatory requirements with regard to advertising and the right to information, and also to avoid “unfair trade practices”.
Also related to consumer rights, of note is the protection of personal data. In this regard, we also practice preventive law, assisting our clients, in particular, in the legalisation of databases, sub-contracting and data transfer agreements, maintaining, whenever possible, close and direct contact with the National Data Protection Authority, whilst also ensuring, whenever necessary, the legal defence of clients in court.
